There is so much to say on this issue, but all we are going to say for right now is:

When you begin making laws and you have different standards for different people based on whatever difference you choose to pay attention to on this day or that day, something is fundamentally wrong with any choice, decision or law that will be created.  Clean the slate.  Start over.
